Aronberg Goldgehn Attorneys Obtain Victory Before Circuit Court of Cook County Regarding the Application of Italian Law
In a recent case brought before the Circuit Court of Cook County concerning the application of Italian law, Aronberg Goldgehn members Benjamin E. Haskin and Jay A. Frank and associate Genc Arifi attained judgment in favor of an international broadcast company client.
The Circuit Court of Cook County heard the case following a prolonged dispute regarding Italian law enforcement in Italy’s judicial system.
Originally, the foreign company registered and sought to enforce judgments obtained in the Italian Tribunal, Appellate and Supreme Court, but ambiguity in the judgments’ wording raised questions of the enforceability of Italian law.
Throughout the case, the involved parties submitted multiple rounds of briefs and participated in oral arguments, including expert testimony on Italian law and procedure.
The court ultimately ruled in favor of the firm’s client, affirming the judgments are valid under Italian law and therefore enforceable in Illinois. Further, the court rejected the argument that the Italian judicial system is the proper forum to resolve the dispute and found that it had the power to do so as the court of enforcement.
As a decisive victory for the firm’s client, the broadcasting company can now enforce and collect upon the judgment it obtained after years of litigation in Italy.
