Chip De Preter Secures Dismissal in Design Patent Infringement Case

Aronberg Goldgehn Member Chip De Preter successfully defended against a design patent infringement lawsuit in the U.S. District Court for the Western District of Pennsylvania. The plaintiff, Homy Casa Limited, alleged infringement on four design patents covering various chair styles.
De Preter prevailed on a motion to dismiss, establishing that the design patents were narrowly limited by prior art, including the iconic shell chair designs of Charles and Ray Eames from the 1950s. Given these limitations, the court agreed that no reasonable juror could find infringement, leading to a dismissal with prejudice.
Homy Casa later sought to overturn the ruling through a motion for reconsideration. However, De Preter successfully defeated the dismissal, with the court reaffirming that the defendant did not infringe any of the four design patents and that the dismissal was properly granted.
