CBA Regulatory Committee to Present "Chevron: Whither the Supreme Court and What is the Future?"


The Chicago Bar Association’s Regulatory and Compliance Committee, co-chaired by Judith S. Sherwin, will feature Prof. Bradley Sayles of Loyola University Chicago School of Law and Prof. Mary T. Nagel of Chicago-Kent College of Law for a discussion on the anticipated Supreme Court decisions in a pair of cases that could overturn the long-established Chevron doctrine.

In 1984, the Supreme Court decided in Chevron v. National Resources Defense Council that while a government agency must conform to clear legislative statements when interpreting or applying law, courts will give the agency deference in an ambiguous situation if the agency’s interpretation is reasonable.

Based on trying to read the tea leaves at oral argument it appears that Chevron deference may be modified or even become a thing of the past. The decision which is looming in two cases pending in the Supreme Court in Loper Bright Enterprises v. Raimondo and Relentless v. Department of Commerce is on the horizon and will likely come soon and certainly by June of this year.
