Christopher Bannon and Amy Rapoport Gibson Obtain Judgment in Dispute over Claims-Made Insurance

Christopher Bannon and Amy Rapoport Gibson, commercial litigation attorneys at Aronberg Goldgehn, recently obtained a judgment in favor of the firm’s client in an insurance coverage declaratory judgment action. A realtor filed an action against our client, an errors and omissions insurer, seeking coverage for a suit in which the realtor was accused of improperly managing commercial property. The Illinois state court judge found that the claim against the realtor was made after the insurer’s “claims-made” policy terminated. Consequently, the policy did not cover the suit against the realtor. The court therefore dismissed all claims against our client in the declaratory judgment action.
