Aronberg Goldgehn Obtains Dismissal of Defamation Claim with Prejudice

Aronberg Goldgehn litigation attorney Benjamin Haskin obtained a defense victory in the Northern District of Illinois by obtaining a dismissal with prejudice of the plaintiff’s claim of defamation per se.
The Motion to Dismiss argued that the underlying statement was a constitutionally protected opinion that was not actionable as defamation. The court agreed, emphasizing that the hyperbolic nature of the alleged defamatory statement did not contain facts to be objectively verifiable. The court also accepted the defense argument that the social context in which the statement was made signals an expression of opinion as opposed to a factual assertion. The dismissal of the defamation claim is a significant victory in the litigation.
