Andy Schwartz Secures Motion Denial in City of Harvey Firefighters' Pension Fund Dispute

Aronberg Goldgehn Member Andy Schwartz secured a key win on behalf of the Harvey Firefighters’ Pension Fund when the court denied the City of Harvey’s motion for preliminary injunction. The ruling ensures that the Illinois comptroller will continue to intercept and distribute funds owed to the Firefighters’ Pension Fund, preserving payments to its 70 retired firefighters and their families.
This decision is the latest in the ongoing litigation that began in 2010, through which the fund has sought enforcement of its statutory funding rights against the city. By defeating the city’s attempt to halt pension payments, the fund preserves financial continuity for its retirees, many of whom rely on their benefits for essential living expenses.
“These retirees spent their careers in service of Harvey and its residents, and uninterrupted pension funding is essential to honoring that service,” Schwartz said. “The court’s decision reinforces the statutory obligations in place and ensures these firefighters and their families can continue to depend on the benefits they earned for their financial security.”
