Aronberg Goldgehn’s Alan S. Wernick summarizes the California Attorney General (CAG’s) recent lawsuit and settlement involving retailer Sephora USA Inc., concerning claims of violating the California Consumer Privacy Act (CCPA) of 2018.

In the American Bar Association’s Month-In-Brief: Internet Law & Cyber-Security article, “CCPA Settlement: Retailer Accused of Violation of Privacy Laws Agrees to Pay $1.2 Million Penalty to California Attorney General,” Alan explains the conditions of the settlement, which include Sephora’s commitment to:

  • Pay $1.2 million to the CAG
  • Update their online disclosures and privacy policies
  • Allow consumers to opt out of the tracking and sale of their personal data
  • Provide up-to-date records to the CAG regarding the sale and purchase of consumer data

Alan notes that any business, regardless of their location, doing business with California residents can be potentially liable under the CCPA. As the CCPA enforcement increases, businesses more than ever need to be CCPA compliant.
