Alan S. Wernick Examines 7th Circuit Appellate Court Decision Regarding BIPA and Collective Bargaining Agreements in Business Law Today

The article, “Biometric Information Privacy Act and Collective Bargaining Agreements,” details the U.S. Court of Appeals, 7th Circuit decision in Fernandez, et al., v Kerry, Inc., 2021 WL 4260667 (CA7, 20210920) in which employees of Kerry, Inc., sought damages under Illinois’ Biometric Information Privacy Act.

Alan shared that employers with a unionized workforce should review their employees’ Collective Bargaining Agreement to establish whether the employer’s biometric processes are appropriately outlined.
