Lisa Brodsky and Amy Rapoport Gibson Win ERISA Appeal in 8th Circuit Court

Aronberg Goldgehn Attorneys, Lisa J. Brodsky and Amy M. Rapoport Gibson recently obtained an appellate court victory before the U.S. Circuit Court of Appeals for the Eight Circuit in IBEW Pension Plan v Wright and Walker

The Eight Circuit affirmed the district court’s decision for summary judgment and the firm’s client succeeded in her claim as the rightful beneficiary to a decedent’s pension benefits over his own mother’s claim. Amy Rapoport Gibson wrote the underlying motion for summary judgment and Lisa Brodsky wrote the appellee’s brief, which was argued before the three-member panel on June 14, 2012.

The opinion is significant as it clarifies various procedural aspects of pursuing and appealing an ERISA claim before a plan administrator and appeals tribunal.
